Just trying to understand here ...
Miami currently has the 10th worst record (meaning they'd keep their pick as long as the lottery doesn't royally screw them). They have 36 wins, and Brooklyn ( who has the 11th worst record) has 37.
If the Heat win and Brooklyn loses, they're tied. I'm guessing (based off the previous posts) that some sort of tiebreaker between Miami/Brooklyn would result in the Heat moving to 11th worst record instead of Brooklyn?

Also, Miami could win tonight and still remain 10th worst record if Brooklyn also wins. Brooklyn plays home against a crappy Orlando team, so Brooklyn could easily win that game. And the Nets have no reason to lose intentionally considering the Hawks own their 1st round pick this year.
