Rufus Tate JR discussed the report with the local new agency. so far it hasn't been refuted.

"In the police report you have so far, there is no description of a threat he received. So we have a real problem with that. But this has been a national discussion for the past two years. There is this perception that a black man is automatically feared," Tate said.

the report may be revised later but for now. the lawyer has concerns because the officers did not state why he was in fear for his safety. nothing in the report outlines a reason for fear.
There has been no information provided on Radio chatter. despite DJ absolving the officer for that reason.
There has been no indication that the gun was a factor.. one would believe the shooting officer would of put that tidbit in his initial report.

there was more than just the two officers on the scene at the time the shooting officer arrived.

What is clear is that officer who was shot. complied to officer orders to get on the ground and that the officers told him to get back up and it has been reported he had his service revolver but its not indicated where it was or if the shooting officer had seen it.

and it has been reported the shooting officer saw the man detained and released although apparently he didn't understand or see that the man had been released by his peers who were closer to the situation.

Who is "Rufus Tate Jr.?"

Because if he happens to be the attorney for the guy that got shot, you'd think he'd be much more categorical than saying something weaselly like "there is no description of a threat he received", because nobody is claiming he "received" a threat. The argument is that he saw a guy with a gun advancing on police.

I mean, you'd think the attorney would say "there is no mention in that police report that he saw my client had a gun", if that was in fact true. Curiously, though, he didn't say that....

On a side not, this is like the sixth time you've quoted a Complaint or a lawyer's claim as evidence of underlying truth. I've yet to read a Complaint in any case that didn't make it sound like the defendant wasn't worse than ol' Adolph himself.

show me a report that refutes Mr Tate and ill be glad to consider his motives but he is commenting on a report that has not made been made public as the identities of the officers have not been released.

I am sure that the new station who put Mr Tate on television ahd a copy of a redacted report but they did not release any information refuting Mr Tates assertion that the officer indicated on the report fear for his safety but did not indicate why.

Would it really behoove Mr Tate to say such a thing if the report clearly stated a reason why the shooting officer was fearful?

Until either the police report is made available or someone actually refutes Mr Tates statement that no reason was provided outside of fear for his safety the concern certainly has merit.

also if the report is updated to where the shooting officer did provide a reason why it wasn't included in the nitial report should be provided as well.


The lawyer wants to know specifically what triggered the shooting officer to believe he had reason to fear for his safety.

if it was a black man walking the crime scene then that is not enough and its racial profiling
I checked the crime reports database . they haven't upload through Wednesday as of yet.

Good question. There is also the whole cultural influence of a department and the fraternity of police. Police have he burden of being tough all the time and acting like they don't need help or are always in authority. They have one of the highest suicide rates of any profession.

There is some PTSD and other things going on. Maybe people aren't meant to do that job for years and years. I'm not sure. I do know that the salt lake City police force hasn't killed anyone since 2015. They made changes based on the outcry from the public. That's not a realistic goal for every City, but why not try something else? The only answer we are getting now is that criminals get what they deserve, and chips are heros. No changes. Things are cool is the only thing that won't work and that is the main strategy.

I am implementing changes at work right now to make things more professional. Everyone that had been there a long time is resistant of course. I can't imagine it with a group of people who must constantly Express superiority and who cannot admit wrongdoing of any kind. Bit of immovable object vs irresistible force.

I even understand rationalizing the killing. If it happens you have to say it was justified or you become a murderer in your own eyes.

Fear of safety doesn't imply anything by fear of safety. the officer did not state in his report what caused him fear.

none of you have provided any reports or information showing that the officer
1. saw a gun
2. that the off duty officer was holding the gun
or anything showing that other than showing up on the scene the guy who got shot did nothing more than stand up and walk towards a group of police officers as he was instructed too.

BUT WE HAVE ENOUGH FACT TO DECLARE IT WASNT RACIAL.

Once again theLaw enforcements officer's attorney has read the report and state that the report did not indicate why the officer was in fear for his safety.

yet none of you will even acknowledge that doing so is standard for a report.

Why would the officer be so vague in a report outlining a shooting?

an 11 year veteran of the police department thinks he was shot because he is black.

I had a friend in high school who drank a lot. He said he would sometimes stumble and trip over stuff in front of his parents on purpose to "throw them off his scent".

I think torn vascillates from being painfully obstinate to trolling pretty frequently.

Has society become so bad? I mean, we understand that these issues are reflective of societal decline, right? I always think of a Marilyn Manson lyric that resonated despite it's...vulgarity. I'll paraphrase, this is our shit, we should be ashamed of what we have eaten.
