I'm not sure how you'd define "classism", but there are some truisms we really can't escape:
Good-looking people tend to do better in life than ugly people, and good looking people are more likely to marry each other. Smart people tend to do better in life than dumb people, and smart people are more likely to marry each other.
And, poor people (especially if they're dumb) are more likely to commit crimes than rich people. One thing criminology studies shows is that criminals, in the aggregate, have below-average I.Q.'s.
Essentially, life fosters inequality because people do not have identical characteristics and abilities, and we're going to tend to have a disproportionate number of dumb, ugly people in prison even if the administration of the system was 100% bias free because those people are statistically more likely to commit crimes in the first place. So if you're going to say that the justice systems fosters "classism"...well, that's why I think you need to better explain what you mean by that.
Also, while I support criminal defendants getting government-provided attorneys, and I support funding the system enough so that those attorneys are not overloaded (which is the case in some places), the truth is that attorneys vary widely in quality, and the better ones are going to charge more. So, rich people are going to tend to get better attorneys.
I don't really see a way to fix that without violating someone's rights.
Intelligence is associated with criminal justice processing: Arrest through incarceration

Abstract
Findings flowing from empirical research consistently indicate that IQ is associated with criminal involvement, with persons of relatively lower IQ being more likely to engage in various types of crime when compared with persons of relatively higher IQ. As with all research, however, there are a number of limitations with the existing literature that may bias the IQ–crime connection in unknown ways. Specifically, previous research has generally analyzed sub-samples drawn from non-nationally representative samples, has relied on a narrow range of criminal justice measures, has not fully examined whether the IQ–crime link is observed across demographic subgroups, and has not always ruled out the effects of potential confounds. The current study is designed to overcome the most serious of these limitations and offer new evidence of the link between IQ and criminal involvement. Analysis of data drawn from the National Longitudinal Study of Adolescent Health (Add Health) provides strong evidence indicating that IQ and crime are linked even after addressing various shortcomings of previous research. Limitations of the study are discussed and directions for future research are offered.

i know you were just making a point, but i challenge you on smart people marrying smart people. i dont have empirical data in hand to back up my assertion, but this is a point ingeminated by an academic I follow. Men do primarily pursue based on phyiscal attraction (I do have a chart for that) and women primarily pursue mates over and up in (dominance) heirachies (primarily finanicial status..it may be that it's the most easily quantified). This, however, is more correlated to THE ABILITY TO climb a dominance heirarchy than it is the standing position of that male (ability to accumulate wealth rather than wealth accumulated. this is most related to intelligence AND EXTRAVERSION).
so hot women marry smart, extraverted men/men with money. But being attractive helps. And if you just have money and are dumb, youre not going to fool the woman. Stand next to a guy that has less money but more upward mobility and you'll lose.
